The Telephone Consumer Protection Act (TCPA) is a federal statute that prohibits these entities from contacting your cell phone through automated calls, texts, or prerecorded messages without your prior express written consent. These unwanted calls, texts, or prerecorded messages are also known as “automated calls” or “robo calls,” and many instances may be made to your cell phone numerous times a week, and sometimes even multiple times a day.

The Telephone Consumer Protection Act makes these activities illegal (1) if you never gave your express consent to receive the automated calls, texts, or prerecorded messages, or (2) after you have expressly revoked your prior consent.  Under the Telephone Consumer Practices Act, you may be entitled to recover between $500 to $1,500 for each unauthorized automated contact made to your cell phone if you have not given consent to be called, or after you have told them to stop the calls.
